The world of decentralized finance (DeFi) and its related technology is advancing at an unprecedented pace (even by its own measures), offering opportunities and challenges in equal measure. These developments present extraordinary opportunities—and equally significant legal, regulatory, and policy questions. In this inaugural blog post for The DeFi Review, we introduce our vision for this platform as a hub for thought leadership and dialogue in the blockchain and fintech industries.

DeFi platforms have disrupted traditional financial systems by offering decentralized lending, borrowing, trading, and other services with and without intermediaries. Globally, regulators are examining how to classify and govern DeFi projects, often applying frameworks designed for centralized systems to a decentralized context. Attorneys have successfully effected service of process via NFT. Novel constructs are being tested and implemented for ownerless and agentic corporate structures, DAOs, and other forms of decentralized association.

In the United States, the debate over the application of securities, commodities, sanctions, money transmission, and other state and federal laws to DeFi protocols and their operations remains a key focus. Enforcement actions by regulatory bodies have drawn significant attention within the industry and raised novel questions regarding jurisdiction and application of tested principles to self-executing contracts. Meanwhile, other jurisdictions are exploring structured approaches to create regulatory frameworks that address transparency and consumer protection.

The Vision for The DeFi Review

As the regulatory environment evolves, The DeFi Review aims to be a trusted resource for attorneys, business professionals, and academics working at the intersection of law, finance, and decentralized technology. Our platform will offer:
